Attorney for Property or Guardian of Property

Are you the Attorney for Property or Guardian of Property for a worker receiving WSIB benefits?

IMPORTANT: All references to worker in the following text also apply to a worker’s survivors.

When to notify the WSIB

The WSIB needs to be advised when, as the worker’s attorney/guardian, you will be dealing with the WSIB regarding the worker’s claim. This can include:

  • signing WSIB forms for the worker
  • making decisions for the worker about the claim

First steps

For the WSIB to recognize you as the attorney or guardian authorized to act on a worker’s behalf with respect to that worker’s claim, you will need to notify us and send the appropriate legal documentation that indicates that you are authorized to act on the worker’s behalf with respect to his or her property. 

Examples of appropriate documentation include:

  • a Continuing Power of Attorney for Property;
  • a document appointing you as the worker’s guardian of property; or
  • an equivalent official document.

Power of Attorney for Personal Care versus Power of Attorney for Property

A Power of Attorney for Personal Care does not authorize you to act on a worker’s behalf with respect to the worker’s WSIB claim. Instead, we need you to provide documentation authorizing you to act on the worker’s behalf with respect to his or her property. 

Next steps

If you have a document naming you as the worker’s power of attorney for property, guardian of property, or the equivalent in other jurisdictions, please submit a copy of that document. 

When we receive the document, we will review it. If we accept the document, we will send you a letter confirming your status as the attorney or guardian for the worker with respect to his or her WSIB claim.

How to submit the legal document

1. Please complete the WSIB
 so that we have the contact information and signature for all person(s) named in the document and currently acting as an attorney or guardian. 

2. Attach the completed and signed form to the front of the legal document.
  • If more than two persons are named in the document and are currently acting as attorneys/guardians, please use the back of the form to provide their contact information and signatures.
  • If the worker has more than one WSIB claim, please list all additional claim numbers on the back of the form.


3. Submit the documents by mail to:
