Commonwealth Caribbean and Mexican seasonal agricultural workers – Workplace injuries: A guide for foreign agricultural workers

Your coverage

Workplace injury or illness coverage starts the day you arrive at the agreed upon departure location in your home country and stays in place until you return home.

While in Ontario, you’re covered when:

  • coming from the airport in Ontario to your employer’s business
  • using a bus or car with your employer’s authorization when travelling to and from your employer’s business on a direct, uninterrupted route
  • taking time off or during meal time while on your employer’s properties
  • sleeping in the accommodation your employer provides

You’re generally not covered when:

  • taking part in recreational activities away from your employer’s properties locations
  • visiting with family and friends

As a foreign agricultural worker in Ontario, you have workplace injury and illness insurance coverage with the WSIB.

We’re here to help. We provide translation services and can help you fill out the forms you need to file a claim.

If you’re injured or become ill at work

1. Get medical help

Your employer is responsible for providing first aid. See a doctor or go to a hospital if you need further treatment. You employer pays for your transportation on the day of the injury.

2. Document

Tell your employer about your injury or illness and any medical treatment you received right away. They investigate and keep a record of what happened.

3. Report to the WSIB

Report your injury or illness if:

  • you need treatment from a doctor or hospital (beyond first aid), or
  • you aren’t able to go to work, or
  • you’re being paid less or receiving fewer hours of work

You can report an injury or illness and follow the steps to submit a Worker’s Report of Injury/Illness (Form 6). Your employer must tell us about an injury or illness within three business days, fill out a claim form and provide you with a copy.

4. Work together

Stay in touch. We’ll work with you and your employer to help you recover and return to work safely, at the right time.

Let us know once you know when you’ll be returning to your home country. We’ll schedule a health assessment where you’ll receive a treatment plan, which you can share with your doctor when you return home. Please call us if you need help finding treatment in your home country; we’ll help you find health care and pay for your treatment and travel for your medical appointments.

We understand some people may not be able to access quality care in their home country. We determine on a case-by-case basis if someone should stay in Ontario during their recovery. Our goal is to get the best recovery outcome for you.
